ELEMENTS OF CASE LAW AND HOW TO ANALYZE THEM

Event Objectives: The primary aim of this course is to dissect case law in order to understand its meaning, how to research it, where to find it, how to read it, what are its elements and how to analyze them, how to implement case law in practice when representing a client in order to enhance the positive outcome of the client’s immigration and citizenship applications, claims for refugee protection, appeals, admissibility hearings, detention reviews, and applications for humanitarian and compassionate considerations (H&C). Apart from this, it is crucial not only to be familiarize with case law but also to comprehend its importance, how it can affect future judicial decisions, shape the law as we know it, and whether the Supreme Court can overturn it. As well as that, a brief overview of a couple of case laws [Kozul v. Canada (Employment and Social Development), 2016 FC 1316; and Roe v. Wade, 410 U.S. 113 (1973)] will be an intrinsic component of this course. .
